Visiting

We are now welcoming visits from families and friends of our patients. Please use our booking system to plan your visit.

Patients are referred directly from an NHS Trust, CCG's, Community Mental Health Team's or Local Authorities. People referred to the hospital are offered a detailed pre-admission assessment to ensure they are suitable to our service and that we can provide the care and treatment to fully meet both their mental health and physical health needs. Following assessment and review of same by MDT the decision regarding admission and potential outcomes is made as quickly as possible. Both patients and their family members are encouraged to visit the hospital prior to admission.

Concerns and Complaints

We take feedback seriously at Barchester and do our best to work with customers if issues occur to put things right and learn lessons for the future.

If, despite our best intentions, the service does not meet your expectations and you are unhappy please contact the General Manager/Hospital Director or any senior member of the team. We are always willing to discuss your concerns and want to hear from you to put things right. There are three stages to our complaints policy at Barchester. At each stage you will receive a written acknowledgement within 3 working days and a full response within 20 working days.

Please note: Complaints can be made by a resident or patient who is affected by an action OR a person acting on a patient’s/ resident’s behalf such as a relative, carer or a duly appointed legal representative. Complaints can be made on behalf of a person who lacks capacity within the meaning of the Mental Capacity Act 2005 as long as Barchester Healthcare is satisfied that the person making the complaint is acting in the best interest of the resident/patient.

Scotland services: - Barchester Healthcare services in Scotland are registered with and regulated by the Care Inspectorate (CI). Raising a concern

Where possible, we want to resolve your concerns informally through great conversations. Tell a member of the team at the home or hospital and they should do their best to resolve any issues. If they cannot resolve the concern you’ve raised within 3 days, it will be escalated to a complaint.

Raising a complaint

The complaints process at Barchester Healthcare has three stages. We find the majority of concerns can be resolved during the first stage. At each stage you will receive a written acknowledgement within 3 working days and a full response within 20 working days.

Stage 1: Listening to you locally

We recommend that all concerns should be raised with the Home Manager/Hospital Director in the first instance, as many issues can be resolved immediately. You can contact them by visiting the home for a meeting, by phone, by email or in writing. Complaints should be raised within 3 months. We do understand it isn’t always possible to raise a complaint directly with the people involved in providing the care, so in that situation you are welcome to raise your complaint with the central team. We will acknowledge your complaint and start a thorough investigation providing a formal written response. In exceptional cases we may request more time to conduct our investigation, if this is the case you will be kept informed and provided with a revised response date.

Stage 2: Listening to you regionally

If you are unhappy with the response you receive from Stage 1, you can contact the General Manager/Hospital Director or Customer Feedback Team within 20 days of receiving a formal written response. They will try to understand the reasons why it is not resolved and allocate to one of our Regional Team Members to review and agree a resolution. Again this will be acknowledged by them, within 3 working days of receiving the escalation and a formal response will be provided within 20 working days.

Stage 3: Listening to you at a senior level

If you don’t feel your complaint has been resolved at Stage 2 let the Customer Feedback Team know, they will refer your complaint to a senior and independent member of the team to investigate and reach a resolution. Please do this within 20 working days of receiving a stage 2 formal written response.

If after Stage 3 you still feel we haven’t reached a resolution you can refer your complaint to an external body:-

Local Government and Social Care Ombudsman provide a free, independent service. Barchester Healthcare supports the LGSCO initiative to provide a single statement that summarises how care providers will look into complaints, to view this statement please click here. We will follow the Ombudsman decision, if you agree with it.

Employee’s policy

Please note: the concerns and complaints process does not cover Barchester Healthcare employees wishing to raise a grievance regarding their employment or the running of the home. If you are an employee and would like to report any kind of information or activity that is deemed illegal, dishonest, or not correct you are encouraged to report your concerns, in confidence. Speak to the General Manager/Hospital Director or Regional/Divisional Director so that the concern can be effectively and promptly investigated OR call 0800 542 5913 (quote 72744). You will not be required to identify yourself but will be asked certain information sufficient to enable Barchester Healthcare to investigate fully.

If you are an employee who has a personal complaint about their own employment you should pursue your concerns through the Company’s grievance procedure, which can be found in the Employee Handbook.

Availability of the Barchester Hospital site

Although we aim to offer you the best service possible, we make no promise that the services at the Barchester Hospital Site will meet your requirements. We cannot guarantee that the service will be fault-free. If a fault occurs in the service you should report it to us and we will attempt to correct the fault as soon as we reasonably can.

Your access to the Barchester Hospital Site may be occasionally restricted to allow for repairs, maintenance or the introduction of new facilities or services. We will attempt to restore the service as soon as we reasonably can.

Limitation of liability

The Barchester Hospital Site provides information and resources and while Barchester Healthcare tries to ensure that material included on the Barchester Hospital Site is correct, reputable and of high quality, it does not make any warranties or guarantees in relation to that content. These Terms and Conditions will be subject to the laws of England and Wales. We will try to solve any disagreements quickly and efficiently. If you are not happy with the way we deal with any disagreement and you want to take court proceedings, you must do so within the United Kingdom.

International use 

We make no promise that materials on the Barchester Hospital Site are appropriate or available for use in locations outside the United Kingdom, and accessing the Barchester Hospital Site from territories where its contents are illegal or unlawful is prohibited. Miscellaneous

Privacy statement for family/carers of residents/patients

At Barchester Healthcare we are committed to protecting your personal data and handling it responsibly. Our Privacy Statement for Relatives, Friends and Carers of Residents/Patients explains how we collect and manage your data. The changes we have made are in line with data protection laws, known as the UK General Data Protection Regulation (“UK GDPR”), effective from 31st January 2021, and the Data Protection Act 2018 (“Data Protection Laws”). This is part of our ongoing commitment to be transparent about how we use your personal data and keep it safe.

1. WHAT IS THE PURPOSE OF THIS PRIVACY STATEMENT?

1.1    Under the UK GDPR and Data Protection Act 2018, we are required to explain to you why we collect your information, how we intend to use that information and whether we will share this information with anyone else. This statement applies to all relatives/friends/carers/visitors with a vested interest in our residents/patients (past and present). 

1.2    It is important that you read this Privacy Statement for Relatives, Friends and Carers of Residents/Patients so that you know how and why we use your information. We may update this Privacy Statement for Relatives, Friends and Carers of Residents/Patients at any time.

1.3.    It is also important that you inform us of any changes to the personal information we hold about you so that the information is accurate and up to date.

2. WHO ARE WE?

2.1    We are Barchester Healthcare Homes Limited (Barchester), a company registered in England and Wales under company number 02849519 and with our registered office at 3rd Floor, The Aspect, Finsbury Square, London, United Kingdom, EC2A 1AS. 

2.2    Barchester is the "Data Controller" for the information which we hold about you. This means that we are responsible for deciding how and why we hold your personal information.

3. OUR DATA PROTECTION OFFICER

3.1    Our Data Protection Officer (DPO) is responsible for overseeing what we do with your information and monitoring our compliance with the Data Protection Laws.

3.2    Our DPO is Michael O’Reilly who is assisted by the Legal Team. 4. TYPES OF PERSONAL INFORMATION WE USE AND OUR LAWFUL BASIS FOR DOING SO

4.1    We process your personal information for a number of reasons. This is to ensure that we can offer our residents/patients with whom you are associated the best care, protection and support possible and regulate the care we provide (for example, in ensuring that our residents needs/preferences can be met, and in relation to complaints raised by or in respect of you in order to regulate the care provided or your conduct or concerns about you which may put residents/our employees at risk); in order to contact you where necessary in relation to their care (for example, in the event of an emergency); and in order to make any necessary decisions around a resident’s placement (including in considering making an offer of, or decision around the sustainability of, a placement). Without this information, we may not be able to offer a resident a placement or sustain the resident’s placement at one of our homes/hospitals.

4.2    In accordance with the Data Protection Laws, we need a lawful basis for collecting and using information about you. These lawful bases are set out in Article 6 of the UK GDPR and, depending on the type of data, may require reliance on additional safeguards set out in Articles 9 and 10 of the UK GDPR and within the Data Protection Act 2018. 

Standard personal data:

4.3    We will process standard personal data about you. Please refer to the Appendix to see the types of data we might process about you.
4.4    Our Article 6 UK GDPR lawful bases for processing this type of data are: 
4.4.1    You have given us clear consent to process your personal data (in the circumstances where consent is the only available lawful basis) (Article 6(1)(a)) of the UK GDPR); or
4.4.2    It is necessary in order for us to perform our contract with the resident/you (Article 6(1)(b) of the UK GDPR); or
4.4.3    It is necessary to meet legal / regulatory obligations (Article 6(1)(c) of the UK GDPR); or
4.4.4    It is necessary for our legitimate interests (where they are not overridden by your rights) (Article 6(1)(f) UK GDPR).
Special categories of personal data:

4.5    Some of the information which we may process about you will be “special category personal data” and criminal activity data. Special category personal data and criminal activity data (see further below) require a greater level of protection than standard personal data. Please refer to the Appendix to see the types of special category personal data and criminal activity data we might process about you.

4.6    Our Article 6 UK GDPR lawful bases for processing this type of data are: 

4.6.1    You have given us consent to process your personal data (in the circumstances where consent is the only available lawful basis) (Article 6(1)(a)) of the UK GDPR); or
4.6.2    It is necessary in order for us to perform our contract with the resident/you (Article 6(1)(b) of the UK GDPR); or
4.6.3    It is necessary to meet legal / regulatory obligations (Article 6(1)(c) of the UK GDPR); or
4.6.4    It is necessary to protect your life (Article 6(1)(d) of the UK GDPR); or
4.6.5    It is necessary for our legitimate interests (where they are not overridden by your rights) (Article 6(1)(f) UK GDPR).
4.7    We also require an Article 9 UK GDPR basis and must meet other additional conditions specified within the Data Protection Act 2018 to process this type of data.  

Criminal activity data:

4.8    We may process information about you in relation to details of criminal activity in relation to proven and unproven criminal offences (including allegations of criminal activity, investigations into criminal activity, details of proceedings and outcomes of proceedings). Please refer to the Appendix for more details of the data we might process about you.

4.9    Our Article 6 UK GDPR lawful bases for processing this type of data are: 

4.9.1    You have given us consent to process your personal data (in the circumstances where consent is the only available lawful basis) (Article 6(1)(a)) of the UK GDPR); or
4.9.2    It is necessary in order for us to perform our contract with the resident/you (Article 6(1)(b) of the UK GDPR); or
4.9.3    It is necessary to meet legal / regulatory obligations (Article 6(1)(c) of the UK GDPR); or
4.9.4    It is necessary for our legitimate interests (where they are not overridden by your rights) (Article 6(1)(f) UK GDPR).
4.10    We also require an additional Article 10 UK GDPR condition for processing this type of data, and must meet other additional conditions specified within Schedule 1 of the Data Protection Act 2018 to process this type of data. 

5. SOURCE OF YOUR PERSONAL INFORMATION

5.1    The information described at section 4 which we collect about you will be obtained through a variety of sources which may include:

5.1.1    from you directly prior to, during or after the resident/patient’s stay with us;
5.1.2    from others prior to, during or after the resident’s/patient’s stay with us;
5.1.3    information created about you in the course of the resident/patient’s stay with us (for example, data recorded within the resident’s care records, care planning records or other ancillary documentation, such as details or your visits or involvement in meetings in relation to their interests and details of any complaints that you have raised); 
5.1.4    information which you have otherwise made public;
5.1.5    from social media activity (such as Facebook, Linkedin etc.);
5.1.6    from external healthcare providers such as the NHS, your GP, hospital staff etc. and multi-disciplinary teams;
5.1.7    from safeguarding authorities / commissioning bodies and Integrated Care Boards / social services and other regulators (such as the Nursing and Midwifery Council and Information Commissioner’s Office) (and in some circumstances, their professional advisors or authorised representatives).
5.1.8    from the Police and other law enforcement agencies (for example, the Home Office), the courts, the Office of the Public Guardian and coroners.
5.1.9    from auditors / professional advisors (including solicitors and insurers). 
5.1.10    from other entities/persons which fall outside of this list which is made known to us which may be related to the patient/resident and their residency; and
5.1.11    because circumstances are variable and change with time there may in some instances be situations outside the list above and we regularly review our Privacy Statement for Relatives, Friends and Carers to assess whether any updates are required.

6. COMPLYING WITH DATA PROTECTION LAW

6.1    We will comply with the Data Protection Laws when using your personal information. At the heart of the Data Protection Laws are the data protection principles (Article 5(1) of the UK GDPR) which say that the personal information we hold about you must be:

6.1.1    processed lawfully, fairly and in a transparent way;
6.1.2    collected only for specified, explicit and legitimate purposes and not used in any way that is incompatible with those purposes;
6.1.3    adequate and relevant to the purposes we have told you about and limited only to those purposes;
6.1.4    accurate and, where necessary, kept up to date;
6.1.5    kept only as long as necessary for the purposes we have told you about; and
6.1.6    processed in a manner that ensures appropriate security.

7. SHARING YOUR INFORMATION

7.1    We will share your personal information with third parties where we have a lawful basis for doing so.

7.2    The types of organisations/persons with which we may share your personal data are as follows:

7.2.1    External healthcare providers and multi-disciplinary teams healthcare providers such as your GP, hospital staff, dentists, other care providers etc;
7.2.2    Safeguarding authorities / commissioning bodies and Integrated Care Boards / social services / other regulators (such as the Nursing and Midwifery Council and the Information Commissioner’s Office) (and in some circumstances, their professional advisors or authorised representatives);
7.2.3    The Police and other law enforcement agencies (for example, the Home Office), the courts, the Office of the Public Guardian and coroners;
7.2.4    IT service providers: we may use external IT or software providers who may have access to your personal data from time to time as is necessary to perform their services;
7.2.5    Attorneys/Deputies or others who are acting in your best interests (including complainants who have a vested interest in a resident’s/patient’s care, or bodies commissioned for the investigation of complaints, such as the Local Government and Social Care Ombudsman);
7.2.6    Auditors / professional advisors (including solicitors and insurers). 

8. TRANSFERRING INFORMATION OUTSIDE OF THE UK AND THE EUROPEAN ECONOMIC AREA (EEA)

8.1    We strive to ensure that any data necessary to be shared with the companies we work with (i.e. our supply chains) remains within the UK or the EEA in the first instance. However, some companies that provide services to us are located in, or run their services from, countries outside of these areas and resultantly, on occasion, your personal data may be transferred to countries outside of these areas. 

9. CAN WE USE YOUR INFORMATION FOR ANY OTHER PURPOSE?

9.1    We typically will only use your personal information for the purposes for which we collect it. It is possible that we will use your information for other purposes as long as those other purposes are compatible with those set out in this Privacy Statement for Relatives, Friends and Carers. If we intend to do so, we will provide you with information relating to that other purpose before using it for the new purpose.

10. STORING YOUR INFORMATION AND DELETING IT

10.1    To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal requirements. We will only retain your personal information in line with periods calculated using such criteria and in consideration of how long it is reasonable to keep records to show we have met the obligations we have to you and by law, any time limits for making a claim, any periods for keeping information which are set by law or recommended by regulators, professional bodies or associations.

10.2    In some circumstances we may anonymise your personal information so that it can no longer be associated with you, in which case we may use such information without further notice to you. 

11. YOUR RIGHTS

11.1    Under certain circumstances, you have the right to:
11.1.1    Request access to your personal information (commonly known as a “data subject access request”). This enables you to receive a copy of the personal information we hold about you and to check that we are lawfully processing it. 
11.1.2    Request correction of the personal information that we hold about you. This enables you to have any incomplete or inaccurate information we hold about you corrected.
11.1.3    Request erasure of your personal information in certain circumstances. This enables you to ask us to delete or remove personal information where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your personal information where you have exercised your right to object to processing (see below).
11.1.4    Object to processing of your personal information where we are relying on a legitimate interest (or those of a third party) or public interest as our lawful basis for processing and there is something about your particular situation which leads you to object to processing on this ground. You also have the right to object if we are processing your personal information for direct marketing purposes.
11.1.5    In the limited circumstances where we are relying on your consent as our lawful basis to process your data for a specific purpose, you have the right to withdraw your consent for that specific processing at any time. If you withdraw your consent, we will no longer process your information for the purpose or purposes you originally agreed to, unless we have another lawful basis for doing so.
11.1.6    Request the restriction of processing of your personal information. This enables you to ask us to suspend the processing of personal information about you, for example if you want us to establish its accuracy or the reason for processing it.
11.1.7    Request the transfer of your personal information to another party.

  1. 1. The standard personal data we may process about you includes:

    -    personal details (such as name, date of birth, gender, nationality), contact details (such as your address, personal telephone number and personal email address);

    -    for data protection, confidentiality and regulatory purposes, confirmation of your identity (where required), to allow us to assess that you are the correct person to be communicating with in respect of a resident/patient before, during and after their residency with us (for example, details of and evidence of your status as their Power of Attorney/Deputy and photographic verification documents);

    -    financial information (such as bank account details, details about your financial assets (for example, details of any property you own) for the purpose of making necessary checks to ensure that the care and accommodation is affordable for you (if you are making payments relating to the resident/patient’s care), and for the purposes administering payments/refunds relating to the resident’s/patient’s stay with us;

    -    information about your family and others (such as dependants, next of kin and emergency contact numbers) so we know who to contact if required in connection to the resident’s/patient’s placement;

    3.     We may process criminal activity data about you. This may include information in relation to allegations of criminality, investigations and proceedings. Where appropriate, we will collect information about criminal convictions as part of the admission process or we may be notified of such information directly by you/others in the course of the resident’s/patient’s residency with us.     -    To protect our residents/patients and staff from the risk of assault, abuse, theft or possession or any other detriment;

    -    In order to meet legal / regulatory obligations.

    -    Less commonly, we may use information relating to criminal convictions where it is necessary in relation to legal claims, where it is necessary to protect your interests (or someone else's interests), or where you have already made the information public.

1. WHAT IS THE PURPOSE OF THIS PRIVACY STATEMENT?

1.1    Under the UK GDPR and Data Protection Act 2018, we are required to explain to you why we collect your information, how we intend to use that information and whether we will share this information with anyone else. This statement applies to all current, former and prospective residents/patients. 

1.2    It is important that you read this Privacy Statement for Residents/Patients so that you know how and why we use your information. We may update this Privacy Statement for Residents/Patients at any time.

1.3    It is also important that you inform us of any changes to the personal information we hold about you so that the information is accurate and up to date.

2. WHO ARE WE?

2.1    We are Barchester Healthcare Homes Limited (Barchester), a company registered in England and Wales under company number 02849519 and with our registered office at 3rd Floor, The Aspect, Finsbury Square, London, United Kingdom, EC2A 1AS. 

2.2    Barchester is the "Data Controller" for the information which we hold about you. This means that we are responsible for deciding how and why we hold your personal information.

3. OUR DATA PROTECTION OFFICER

3.1    Our Data Protection Officer (DPO) is responsible for overseeing what we do with your information and monitoring our compliance with the Data Protection Laws.

3.2    Our DPO is Michael O’Reilly who is assisted by the Legal Team. If you have any concerns or questions about our use of your personal data, you can contact raise these by emailing dpo@barchester.com or writing to Data Protection Officer, 3rd Floor, The Aspect, Finsbury Square, London, United Kingdom, EC2A 1AS. Alternatively, if you wish to make contact but are unable to use any of the above methods, please contact your local General Manager or Hospital Manager who will be able to put your queries forward to the team.

4. TYPES OF PERSONAL INFORMATION WE USE AND OUR LAWFUL BASIS FOR DOING SO

4.1    We process your personal information for a number of reasons. We ask for information about you so that we can make sure we offer you the best care, protection and support. If you refuse to provide certain information when requested, we may not be able to offer you a placement or sustain your placement at one of our homes/hospitals as we require certain information in order to comply with our legal obligations, perform our contract for the provision of services to you and to ensure your health and safety and the health and safety of those around you.

4.2    In accordance with the Data Protection Laws, we need a lawful basis for collecting and using information about you. These lawful bases are set out in Article 6 of the UK GDPR and, depending on the type of data, may require reliance on additional safeguards set out in Articles 9 and 10 of the UK GDPR and within the Data Protection Act 2018. 

Standard personal data:

4.3    We will process standard personal data about you. Please refer to the Appendix to see the types of data we might process about you.
4.4    Our Article 6 UK GDPR lawful bases for processing this type of data are: 

4.4.1    You have given us clear consent to process your personal data (in the circumstances where consent is the only available lawful basis) (Article 6(1)(a)) of the UK GDPR); or
4.4.2    It is necessary in order for us to perform our contract of employment with you (Article 6(1)(b) of the UK GDPR); or
4.4.3    It is necessary to meet legal / regulatory obligations (Article 6(1)(c) of the UK GDPR); or
4.4.4    It is necessary for our legitimate interests (where they are not overridden by your rights) (Article 6(1)(f) UK GDPR).


Special categories of personal data:

4.5    Some of the information which we may process about you will be “special category personal data” and criminal activity data. Special category personal data and criminal activity data (see further below) require a greater level of protection than standard personal data. Please refer to the Appendix to see the types of special category personal data and criminal activity data we might process about you.

4.6    Our Article 6 UK GDPR lawful bases for processing this type of data are: 

4.6.1    You have given us consent to process your personal data (in the circumstances where consent is the only available lawful basis) (Article 6(1)(a)) of the UK GDPR); or
4.6.2    It is necessary in order for us to perform our contract of employment with you (Article 6(1)(b) of the UK GDPR); or
4.6.3    It is necessary to meet legal / regulatory obligations (Article 6(1)(c) of the UK GDPR); or
4.6.4    It is necessary to protect your life (Article 6(1)(d) of the UK GDPR); or
4.6.5    It is necessary for our legitimate interests (where they are not overridden by your rights) (Article 6(1)(f) UK GDPR).
4.7    We also require an Article 9 UK GDPR basis and must meet other additional conditions specified within the Data Protection Act 2018 to process this type of data.  

Criminal activity data:

4.8    We may process information about you in relation to details of criminal activity in relation to proven and unproven criminal offences (including allegations of criminal activity, investigations into criminal activity, details of proceedings and outcomes of proceedings). Please refer to the Appendix for more details of the data we might process about you.

4.9    Our Article 6 UK GDPR lawful bases for processing this type of data are: 

4.9.1    You have given us consent to process your personal data (in the circumstances where consent is the only available lawful basis) (Article 6(1)(a)) of the UK GDPR); or
4.9.2    It is necessary in order for us to perform our contract of employment with you (Article 6(1)(b) of the UK GDPR); or
4.9.3    It is necessary to meet legal / regulatory obligations (Article 6(1)(c) of the UK GDPR); or
4.9.4    It is necessary for our legitimate interests (where they are not overridden by your rights) (Article 6(1)(f) UK GDPR).
4.10    We also require an additional Article 10 UK GDPR condition for processing this type of data, and must meet other additional conditions specified within Schedule 1 of the Data Protection Act 2018 to process this type of data. 

5. SOURCE OF YOUR PERSONAL INFORMATION

5.1    The information described at section 4 which we collect about you will be obtained through a variety of sources which may include:

5.1.1    From you directly prior to, during or after your stay with us;
5.1.2    From your friends, relatives/authorised representatives or others prior to, during or after your stay with us;
5.1.3    information created about you in the course of your stay with us (for example, data recorded within your care records and care planning, such as observations and interactions); 
5.1.4    information which you have otherwise made public;
5.1.5    from social media activity (such as Facebook etc.);
5.1.6    from external healthcare providers such as the NHS, your GP, hospital staff, dentists etc. and multi-disciplinary teams;
5.1.7    from safeguarding authorities / commissioning bodies and Integrated Care Boards / social services / other regulators (such as the Nursing and Midwifery Council and Information Commissioner’s Office) (and in some circumstances, their professional advisors or authorised representatives).
5.1.8    from the Police and other law enforcement agencies (for example, the Home Office), the courts, the Office of the Public Guardian and coroners.
5.1.9    from Attorneys/Deputies or others who are acting in your best interests.
5.1.10    from Auditors / professional advisors (including solicitors and insurers). 
5.1.11    from other entities/persons which fall outside of this list which is made known to us in relation to your residency; and
5.1.12    because circumstances are variable and change with time there may in some instances be situations outside the list above and we regularly review our Privacy Statement for Residents/Patients to assess whether any updates are required.

6. COMPLYING WITH DATA PROTECTION LAW

6.1    We will comply with the Data Protection Laws when using your personal information. At the heart of the Data Protection Laws are the data protection principles (Article 5(1) of the UK GDPR) which say that the personal information we hold about you must be:

6.1.1    processed lawfully, fairly and in a transparent way;
6.1.2    collected only for specified, explicit and legitimate purposes and not used in any way that is incompatible with those purposes;
6.1.3    adequate and relevant to the purposes we have told you about and limited only to those purposes;
6.1.4    accurate and, where necessary, kept up to date;
6.1.5    kept only as long as necessary for the purposes we have told you about; and
6.1.6    processed in a manner that ensures appropriate security.

7. SHARING YOUR INFORMATION

7.1    We will share your personal information with third parties where we have a lawful basis for doing so.

7.2    The types of organisations/persons with which we may share your personal data are as follows:

7.2.1    External healthcare providers and multi-disciplinary teams healthcare providers such as your GP, hospital staff, dentists, other care providers etc;
7.2.2    Safeguarding authorities / commissioning bodies and Integrated Care Boards / other regulators (such as the Nursing and Midwifery Council and the Information Commissioner’s Office) (and in some circumstances, their professional advisors or authorised representatives);
7.2.3    The Police and other law enforcement agencies (for example, the Home Office), the courts, the Office of the Public Guardian and coroners;
7.2.4    IT service providers: we may use external IT or software providers who may have access to your personal data from time to time as is necessary to perform their services;
7.2.5    Attorneys/Deputies or others who are acting in your best interests (including complainants who have a vested interest in your care, or bodies commissioned for the investigation of complaints, such as the Local Government and Social Care Ombudsman);
7.2.6    Auditors / professional advisors (including solicitors and insurers). 

8. TRANSFERRING INFORMATION OUTSIDE OF THE UK AND THE EUROPEAN ECONOMIC AREA (EEA)

8.1    We strive to ensure that any data necessary to be shared with the companies we work with (i.e. our supply chains) remains within the UK or the EEA in the first instance. However, some companies that provide services to us are located in, or run their services from, countries outside of these areas and resultantly, on occasion, your personal data may be transferred to countries outside of these areas. 

9. CAN WE USE YOUR INFORMATION FOR ANY OTHER PURPOSE?

9.1    We typically will only use your personal information for the purposes for which we collect it. It is possible that we will use your information for other purposes as long as those other purposes are compatible with those set out in this Privacy Statement for Residents/Patients. If we intend to do so, we will provide you with information relating to that other purpose before using it for the new purpose.

10. STORING YOUR INFORMATION AND DELETING IT

10.1    To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal requirements. We will only retain your personal information in line with periods calculated using such criteria and in consideration of how long it is reasonable to keep records to show we have met the obligations we have to you and by law, any time limits for making a claim, any periods for keeping information which are set by law or recommended by regulators, professional bodies or associations.

10.2    In some circumstances we may anonymise your personal information so that it can no longer be associated with you, in which case we may use such information without further notice to you. 

11. YOUR RIGHTS

11.1    Under certain circumstances, you have the right to:
11.1.1    Request access to your personal information (commonly known as a “data subject access request”). This enables you to receive a copy of the personal information we hold about you and to check that we are lawfully processing it. 
11.1.2    Request correction of the personal information that we hold about you. This enables you to have any incomplete or inaccurate information we hold about you corrected.
11.1.3    Request erasure of your personal information in certain circumstances. This enables you to ask us to delete or remove personal information where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your personal information where you have exercised your right to object to processing (see below).
11.1.4    Object to processing of your personal information where we are relying on a legitimate interest (or those of a third party) or public interest as our lawful basis for processing and there is something about your particular situation which leads you to object to processing on this ground. You also have the right to object if we are processing your personal information for direct marketing purposes.
11.1.5    In the limited circumstances where we are relying on your consent as our lawful basis to process your data for a specific purpose, you have the right to withdraw your consent for that specific processing at any time. If you withdraw your consent, we will no longer process your information for the purpose or purposes you originally agreed to, unless we have another lawful basis for doing so.
11.1.6    Request the restriction of processing of your personal information. This enables you to ask us to suspend the processing of personal information about you, for example if you want us to establish its accuracy or the reason for processing it.
11.1.7    Request the transfer of your personal information to another party.

-    personal details (such as name, date of birth, gender, nationality, marital status, national insurance number), contact details (such as your address, personal telephone number and personal email address), and confirmation of your identity, to allow us to assess that you are suitable to reside within one of our care homes/hospitals and for the purposes of communicating with you before, during and after your residency with us for reasons connected to your residency;

-    financial information (such as bank account details, details about your financial assets (for example, details of any property you own) for the purpose of making necessary checks to ensure that the care and accommodation is affordable for you, and for the purposes administering payments for your stay with us;

-    information about your family and others (such as dependants, next of kin and emergency contact numbers) so we know who to contact if there is an emergency;

-    information about: your likes and dislikes (relating to hobbies, food, routines and other categories of likes and dislikes which help us improve your care); your care preferences; your life history (in order to ensure that we help you feel at home with us it is important for us to get to know you as best we can); and information about your long-term wishes (such as your desired arrangements in the event that you pass away while staying with us). People we spoke with told us they were very comfortable and they felt, "Very safe", they both told us the staff were "Brilliant" and that they got on well with staff. One relative we spoke to told us the, "Staff do their best and they keep me updated, the staff are all very good". Other comments relatives told us were, "The consultant psychiatrist is very approachable and my relative always looks clean and he is looked after well" and "The hospital is absolutely fantastic, the care is super, the personal care given to xxxx is also fantastic". We were also told that their relative had really settled at this hospital and the staff were very willing to listen and spend time with xxxx.

Billingham Grange (all comments are taken from the independent Care Quality Commission’s reports):

We spoke with six patients and observed the staff practice on the units. Patients told us that they were happy with the care they were receiving and thought highly of the staff. One patient said, "The staff are very, very good and nothing is a bother." Most patients were unable to make extensive comments about their care due to their limited speech but nonverbally indicated that they were happy with the care. From observations we found staff understood patients care needs and consistently worked in a person-centred manner. We found there were good systems in place for working with other health and care professionals. We found there were good systems in place for monitoring the quality of the service and consistently worked in a person-centred manner.

Forest Hospital (all comments are taken from the independent Care Quality Commission’s reports):

We used a number of different methods to help us understand the experiences of patients because patients had complex needs which meant they were not able to tell us their experiences. On the day of our inspection there were two patients using the service. We observed care being delivered and checked both patients care and support records. We spoke with nurses and rehabilitation assistants along with the hospital director and hospital matron. One patient told us they were happy with the care they received and they were able to tell us they felt safe and cared for. We found that patients received care and treatment for their physical and mental health needs that was effective, safe and appropriate. We saw that care was being delivered in a way that was intended to ensure patients safety and welfare because appropriate levels of observation were maintained at all times. We found that patients were protected from abuse, or the risk of abuse, and their human rights were respected and upheld.

Windermere (all comments are taken from the independent Care Quality Commission’s reports):

Patients who were able to speak with us told us they were involved in decisions about their support and treatment. They commented "Staff are great, they do look after me." "I like the food here, and can ask for snacks when I fancy a biscuit." and "Yes, they do ask me what I need and explain things to me when I say I want to go and watch the football match." Relatives and people who used the service told us that they were always involved in decision making. People who used the service were provided with a balanced and varied diet. Health professionals provided guidance and treatment when required. People were happy with the care they received and told us they saw a range of health professionals for advice and treatment.

Jasmine Court (all comments are taken from the independent Care Quality Commission’s reports):

One relative told us told us, "I am involved in decisions regarding my relative every step of the way." We observed that staff treated people with respect and kindness while delivering appropriate levels of care and support. We also saw that care was delivered in a way that met people's individual needs and welfare requirements.

We spoke with several people who used the service and they told us they could make choices about going out and taking part in activities. Comments included, "I have been baking today", "I like to go for walks and to the shops" and "They (the staff) are very nice and kind." We spoke with one relative who told us their concerns had been listened to and action taken to address them. They commented, "The management and staff are wonderful and they have sorted all of the concerns I had" and "My husband is doing well and seems settled" and "We have just had a carers meeting and everyone is extremely happy with the care and support offered."
